LETTERS OF ADMINISTRATION

When a person passes away without a valid Will, or where the appointed executor is unable or unwilling to act, an application may be required for Letters of Administration.

This is a legal process through the Supreme Court of New South Wales that allows an appropriate person to be formally appointed to manage and administer the deceased estate.

WHAT ARE LETTERS OF ADMINISTRATION?

Letters of Administration are a Court-issued authority that allows a person (known as the administrator) to:

  • Collect and manage the deceased’s assets
  • Pay any outstanding debts and liabilities
  • Distribute the estate in accordance with the laws of intestacy
  • Deal with banks, superannuation funds, and other institutions

WHEN ARE LETTERS OF ADMINISTRATION REQUIRED?

An application for Letters of Administration may be required when:

  • There is no valid Will
  • The Will does not appoint an executor
  • The named executor is unable or unwilling to act
  • The executor has passed away

WHO CAN APPLY?

The following people may be eligible to apply:

  • Spouse or de facto partner
  • Children of the deceased
  • Other close relatives
  • A person with a significant interest in the estate

The Court determines who is the most appropriate person to act as administrator.

THE PROCESS

Applying for Letters of Administration involves several steps, including:
